1. Definitions
"Kronobi": KRONOBI LIMITED, publisher of the Service.
"User": any natural person of legal age who has created an account on the Kronobi application.
"Service": all features of the Kronobi mobile app (a safety device that discreetly triggers a geolocated alert to trusted contacts) and of the kronobi.app website. Kronobi is not a crypto wallet: the application does not generate, store or transact any actual cryptocurrency.
"Trusted Contacts": the emergency contacts entered by the User, recipients of the alerts.
2. Object
Kronobi is a digital safety device built for crypto holders. The Service integrates a discreet alert-triggering mechanism with geolocation directed to the User's emergency contacts. Kronobi does not hold, store or manage any actual cryptocurrency belonging to Users, these remain in the wallets the User already uses elsewhere (Ledger, MetaMask, Phantom, etc.). The Service is designed to protect Users against physical threats (wrench attacks, assaults, abductions).
3. Acceptance
Use of the Service implies full and unconditional acceptance of the Terms in force on the day of use. If you do not accept all or part of these Terms, you must refrain from using the Service.
4. Legal capacity
The Service is strictly reserved for natural persons of legal age and legally capable. Account creation by a minor or a person under guardianship is prohibited. Kronobi reserves the right to suspend any account not meeting this condition.
5. Account creation and management
Registration requires a valid email address, with a strong password or Google sign-in, and verification of a phone number. The User undertakes to provide accurate information and to keep it up to date. The User is solely responsible for keeping their credentials confidential. Any action taken from their account is deemed to have been taken by them. Each account is strictly personal and non-transferable.
6. Subscriptions and billing
Paid subscriptions (Solo, VIP) are charged monthly or annually, as chosen by the User, all taxes included, in the currency shown at checkout (euro or US dollar). Renewal is automatic unless cancelled before the renewal date. Payments are processed by Stripe (card) or in cryptocurrency through Coinbase Commerce. An electronic invoice is made available to the User.
7. Trial period
No free trial is offered. The subscription is charged at sign-up, then at each monthly or annual renewal. Free months may be granted under the referral programme, on the terms shown in the app.
8. Right of withdrawal
Under Article 16 of Directive 2011/83/EU on consumer rights, the 14-day right of withdrawal does not apply once performance of the Service has begun with the User's express consent and acknowledgement that the right is lost (the case for any activated subscription). The User expressly acknowledges waiving the right of withdrawal when activating the Service.
9. User's cryptocurrencies
Kronobi is not a crypto wallet. The application does not generate, store, hold or transact any actual cryptocurrency belonging to the User. The User's real crypto remains in the third-party wallets they use elsewhere (hardware wallets such as Ledger / Trezor, software wallets such as MetaMask / Phantom, or others). Kronobi has no technical means to access, transfer or view them. The User retains full responsibility for managing and backing up their own crypto wallets.
10. Service availability
Kronobi implements all reasonable means to ensure 99.5% Service availability. Interruptions may however occur for scheduled maintenance (notified 48 hours in advance) or in case of force majeure. No guarantee of absolute availability can be given.
11. Limitation of liability
Kronobi cannot be held liable for direct or indirect damages resulting from: a force majeure event; a network outage (Internet, mobile, satellite); a failure of SMS, GPS operators or third-party services (Twilio, Stripe, Firebase); use contrary to these Terms. THE SERVICE DOES NOT IN ANY WAY REPLACE OFFICIAL EMERGENCY SERVICES (911, 112), the User is encouraged to always contact these services first in any vital emergency.
12. Prohibited behaviors
The following are strictly prohibited: identity theft, circumvention of security mechanisms, use of the Service for illegal purposes (financing of criminal activities, money laundering, fraud), abusive triggering of alerts, mass data extraction. Any breach results in immediate suspension of the account and, where applicable, reporting to the competent authorities.
13. Regulatory compliance
Because Kronobi is not a crypto wallet and does not perform any operation on actual cryptocurrencies, the Service falls outside the scope of crypto-asset service provider obligations (PSAN / MiCA). No KYC is required to use the safety device. Kronobi nonetheless complies with applicable data protection obligations (GDPR) and cooperates with authorities upon legal requisition regarding account data (email, plan, login IP address).
14. Personal data
The processing of personal data is governed by our Privacy Policy, accessible at kronobi.app/en/confidentialite. This policy is an integral part of these Terms.
15. Intellectual property
The Service, its source code, design, trademarks, logos and content are the exclusive property of KRONOBI LIMITED. The User benefits from a personal, non-exclusive and non-transferable right of use, limited to the duration of their subscription. Any reproduction, decompilation or extraction without written authorization is strictly prohibited.
16. Termination by the User
The User may cancel their subscription at any time from the application (Settings → Subscription → Cancel). Cancellation takes effect at the end of the current billing period. No prorated refund is due. Account deletion (and of all associated data) can be requested by email to privacy@kronobi.app.
17. Termination by Kronobi
In case of serious breach of these Terms (notably article 12), Kronobi reserves the right to suspend or terminate the account without notice and without refund, after notification to the User where possible.
18. Modifications of the Terms
Kronobi reserves the right to modify these Terms. Any material modification is notified by email and in the application at least 30 days before its entry into force. Continued use of the Service constitutes acceptance. Otherwise, the User has the right to terminate without charge.
19. Complaints and amicable settlement
In the event of a dispute, the User is invited to contact Kronobi first at contact@kronobi.com to seek an amicable solution. A consumer User can also get free help from the European Consumer Centre of their country of residence (ECC-Net network).
20. Governing law and jurisdiction
These Terms are governed by Irish law. This does not deprive a consumer User of the protection afforded by the mandatory provisions of the law of their country of residence. Any dispute falls within the jurisdiction of the courts of Ireland; a consumer User may also bring proceedings before the courts of their country of residence.
